FoodLuv is a product created and operated by R2 Consulting, LLC, a Colorado limited liability company. This FoodLuv Customer Privacy Policy (the "Privacy Policy") explains how R2 Consulting, LLC ("FoodLuv," "we," "us," or "our") collects, uses, discloses, retains, and protects personal information when individuals use FoodLuv's customer-facing websites, digital menus, online ordering pages, checkout pages, pickup or delivery tools, waitlist features, catering request tools, loyalty functionality, order notifications, and related services (collectively, the "Platform").

This Privacy Policy applies to customers and visitors who use FoodLuv to interact with restaurants, caterers, food service providers, and other businesses that use FoodLuv (each, a "Merchant"). It is intended for customers, not Merchants or Merchant administrators. Merchants may have their own privacy notices that apply to their independent use of personal information.

1. Data Roles: FoodLuv and Merchants

FoodLuv provides technology that allows Merchants to offer online ordering, digital menus, delivery and pickup workflows, payment checkout, customer communications, and restaurant operations. In many cases, FoodLuv processes Customer personal information on behalf of the Merchant to help the Merchant fulfill orders, provide services, communicate with Customers, manage operations, and comply with legal obligations.

FoodLuv may also use certain personal information for its own business purposes, such as securing and improving the Platform, preventing fraud, providing customer support, generating analytics, enforcing terms, complying with law, and communicating about FoodLuv services.

2. Personal Information We Collect

Depending on how you use the Platform, FoodLuv may collect the following categories of personal information:

Identifiers

Name, email address, phone number, account credentials, delivery address, billing address, IP address, device identifiers, and online identifiers.

Customer Records and Transaction Information

Order details, payment-related information, billing details, support requests, receipts, refunds, tips, taxes, and transaction records. FoodLuv generally relies on third-party payment processors and does not intentionally store full payment card numbers unless expressly disclosed.

Commercial Information

Restaurants viewed, menu items selected, orders placed, pickup or delivery preferences, catering requests, discounts, gift card or loyalty activity, and transaction history.

Internet or Electronic Network Activity

Pages viewed, links clicked, session activity, device type, browser type, operating system, referring URLs, cookie identifiers, diagnostics, logs, and usage analytics.

Geolocation Information

Approximate location derived from IP address, delivery or pickup location you provide, and precise location if enabled with appropriate permission.

User-Submitted Content

Reviews, ratings, photos, support messages, chat messages, survey responses, feedback, special instructions, and other content you submit.

Inferences

Preferences inferred from order history, restaurants selected, cuisine interests, fulfillment preferences, or engagement with promotions.

Sensitive Personal Information

Limited sensitive personal information may be processed, such as account login credentials, precise geolocation if enabled, or information you voluntarily include in special instructions that may reveal health, dietary, religious, or other sensitive information. You should avoid submitting sensitive information unless necessary.

Merchants

We share relevant order, contact, payment-status, delivery, pickup, loyalty, catering, waitlist, and support information with the Merchant you interact with so the Merchant can fulfill your request and operate its business.

Service Providers and Processors

We disclose information to vendors that provide hosting, cloud infrastructure, payment processing, analytics, email, SMS, fraud prevention, security, customer support, database management, delivery/logistics integrations, and other operational services.

Payment and Financial Partners

We disclose payment-related information to payment processors, card networks, banks, fraud-prevention providers, and related entities to process transactions and prevent fraud.

Delivery and Logistics Providers

If your order involves delivery, we may disclose information needed to complete delivery, such as name, contact information, delivery address, order details, and delivery instructions.

Legal and Compliance Recipients

We may disclose information to law enforcement, regulators, courts, legal advisors, auditors, or other parties when necessary to comply with law, enforce rights, protect safety, investigate fraud, or respond to legal process.

FoodLuv and its service providers may use cookies, pixels, local storage, SDKs, device identifiers, and similar technologies to operate the Platform, maintain sessions, remember preferences, analyze usage, improve performance, prevent fraud, and support marketing where permitted. You can manage cookies through browser or device settings and any cookie preference tool made available on the Platform. Blocking cookies may affect functionality.

Where permitted by law, FoodLuv or Merchants may send promotional emails, text messages, or other marketing communications. You may opt out of marketing emails by using the unsubscribe link or contacting dataprivacy@r2c.io. You may opt out of marketing text messages by following the message instructions, such as replying "STOP," where applicable. We may still send transactional or service-related messages.

9. CCPA/CPRA Notice for California Residents

This section applies to California residents and is intended to satisfy the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA").

We collect and use personal information for the business and commercial purposes described in this Privacy Policy, including providing the Platform, fulfilling orders, supporting Merchants, processing transactions, securing the Platform, preventing fraud, analytics, customer support, legal compliance, and communications.

We may disclose the categories above to Merchants, service providers, processors, payment processors, delivery/logistics providers, analytics providers, security providers, legal/compliance recipients, and business transfer recipients.

Sale or Sharing

FoodLuv does not sell personal information for money. Certain uses of cookies, pixels, analytics, or advertising technologies may be considered "sharing" or a "sale" under California law if used for cross-context behavioral advertising. Where required, FoodLuv will provide a "Do Not Sell or Share My Personal Information" mechanism or honor legally recognized opt-out preference signals.

Sensitive Personal Information

FoodLuv does not use or disclose sensitive personal information for purposes that require a right to limit under the CCPA unless we provide a legally required mechanism to exercise that right.

California Privacy Rights

California residents may have the right to know, access, delete, correct, opt out of sale or sharing, limit certain uses of sensitive personal information, receive information about data practices, and not be discriminated against for exercising privacy rights.

Authorized agents may submit requests where permitted by law, but we may require proof of authorization and verification of the consumer's identity.

Depending on where you live, you may have the right to access personal data, correct inaccurate data, delete data, restrict processing, object to processing based on legitimate interests or direct marketing, withdraw consent, receive a portable copy of data, lodge a complaint with a supervisory authority, and challenge certain automated decisions where applicable.

FoodLuv provides a Data Subject Access Request ("DSAR") mechanism for Customers who wish to exercise privacy rights under applicable law. To submit a DSAR, visit https://governdata.ai/foodluv.

Through this portal, you may request access, deletion, correction, portability, opt-out, restriction, objection, or other privacy rights available under applicable law. FoodLuv may verify your identity, request additional information, coordinate with the applicable Merchant, and respond within the timeframe required by law.

Because FoodLuv may process certain Customer information on behalf of Merchants, some requests may require coordination with the Merchant that collected or controls the relevant information. If a Merchant is responsible for responding to your request, FoodLuv may forward or support the request as appropriate.

12. Data Retention

FoodLuv retains personal information for as long as reasonably necessary to provide the Platform, fulfill orders, maintain records, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, support operations, and meet Merchant contractual requirements. When information is no longer needed, FoodLuv will delete, de-identify, or aggregate it where appropriate.

13. Security

FoodLuv uses administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, and disclosure. No system is completely secure, and FoodLuv cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

14. Children's Privacy

The Platform is not intended for children under 13, and FoodLuv does not knowingly collect personal information from children under 13. If we learn that we collected personal information from a child under 13 without appropriate consent, we will take steps to delete it. If a jurisdiction requires a higher age threshold, we will comply with applicable law.

15. International Transfers

FoodLuv may process and store personal information in the United States and other countries where we or our service providers operate. Where required, FoodLuv uses appropriate safeguards for international transfers, such as contractual protections or other legally recognized mechanisms.

16. Automated Decision-Making

FoodLuv may use automated systems to support fraud detection, security, order routing, analytics, personalization, or platform reliability. FoodLuv does not use automated decision-making that produces legal or similarly significant effects on Customers unless disclosed and permitted by law.
